1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Luxury Hotel Casino ("we," "us," or "our"), concerning your access to and use of our website, mobile application, and services offered at our physical location.

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access our services.

We reserve the right to make changes to these Terms at any time. Your continued use of our services following the posting of revised Terms means that you accept and agree to the changes.

2. Definitions

In these Terms, the following definitions apply:

• "Account" means the account created by a User to access and use the Services.
• "Content" means any text, graphics, images, music, software, audio, video, information, or other materials appearing on or through the Services.
• "Order" means a request to purchase Products through the Services.
• "Products" means the fruits, vegetables, and other items offered for sale through the Services.
• "Subscription" means a recurring Order for Products at specified intervals.

3. Account Registration and Use

3.1 Account Creation

When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. You are responsible for safeguarding your password and for all activities that occur under your Account. You agree to notify us immediately if you suspect any unauthorized use of your Account.

3.2 Age Requirement

You must be at least 21 years old to create an Account and use our Services. By creating an Account, you represent and warrant that you are at least 21 years old.

3.3 One Account Per User

You may not create more than one Account without our express permission. We reserve the right to terminate any duplicate Accounts.

3.4 Account Termination

We reserve the right to suspend or terminate your Account at any time for any reason, including but not limited to violation of these Terms. You may also terminate your Account at any time by contacting our customer service.

4. Booking and Reservation Policies

4.1 Reservation Confirmation

Reservations are confirmed only after you receive a confirmation email or notification from us. A reservation confirmation does not guarantee specific room assignments or views.

4.2 Check-in and Check-out

Standard check-in time is 3:00 PM, and check-out time is 11:00 AM local time. Early check-in and late check-out may be available for an additional fee, subject to availability.

4.3 Guest Information

You agree to provide accurate and complete information for all guests in your party. We reserve the right to refuse service or access to any person who does not provide valid identification upon check-in.

4.4 Maximum Occupancy

Each room has a maximum occupancy limit, which may not be exceeded. Additional charges may apply for extra guests within the allowable occupancy limit.

5. Payment Terms

5.1 Rates and Fees

All rates are quoted in US Dollars and are subject to applicable taxes and fees. Some amenities or services may incur additional charges, which will be disclosed at the time of booking or at the property.

5.2 Payment Methods

We accept major credit cards, including Visa, MasterCard, American Express, and Discover. A valid credit card is required to guarantee your reservation.

5.3 Deposit and Pre-authorization

A deposit or pre-authorization on your credit card may be required at the time of booking or check-in. This amount will be clearly communicated to you before it is charged.

5.4 Resort Fee

A daily resort fee may be charged in addition to the room rate. This fee covers various amenities and services, which will be specified at the time of booking.

6. Cancellation and Refund Policy

6.1 Standard Cancellation

For standard reservations, cancellations made at least 48 hours prior to the scheduled arrival date will receive a full refund of the deposit, minus any applicable processing fees.

6.2 Late Cancellation

Cancellations made less than 48 hours before the scheduled arrival date may be subject to a cancellation fee equivalent to one night's stay plus applicable taxes.

6.3 No-Show

If you fail to check in on your scheduled arrival date without prior notification (no-show), you may be charged for the entire reservation period or a minimum of one night's stay, as specified at the time of booking.

6.4 Special Event and Group Bookings

Special event periods and group bookings may have different cancellation policies, which will be clearly communicated at the time of booking.

7. User Conduct

7.1 Prohibited Activities

When using our services, you agree not to engage in any of the following prohibited activities:

• Violating any applicable laws, regulations, or these Terms
• Engaging in any harassing, abusive, or disruptive behavior
• Impersonating any person or entity
• Attempting to gain unauthorized access to our systems or interfere with service to any user, host, or network
• Using our services for any illegal or unauthorized purpose
• Engaging in any activity that disrupts or diminishes the quality of our services

7.2 Property Rules

While on our property, you agree to abide by all posted rules and regulations, including but not limited to:

• Non-smoking policies in designated areas
• Pet policies
• Noise restrictions
• Pool and amenity usage guidelines
• Parking regulations

Violation of these rules may result in additional charges, eviction from the property without refund, or other actions as deemed appropriate by management.

8. Intellectual Property Rights

8.1 Our Intellectual Property

The content, organization, graphics, design, compilation, magnetic translation, digital conversion, and other matters related to the website and our services are protected under applicable copyrights, trademarks, and other proprietary rights. The copying, redistribution, use, or publication by you of any such matters or any part of our services, except as allowed by these Terms, is strictly prohibited.

8.2 License to Use Content

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our services for your personal, non-commercial use. This license does not include the right to:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software contained on our website
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

9. Gaming Rules and Regulations

9.1 Legal Age Requirement

You must be at least 21 years of age to enter the casino floor or participate in any gaming activities. Valid government-issued photo identification may be required at any time.

9.2 Compliance with Gaming Laws

All gaming activities are subject to the rules and regulations of the Nevada Gaming Control Board and other applicable gaming authorities. You agree to comply with all such rules and regulations while on our property.

9.3 Responsible Gaming

Luxury Hotel Casino promotes responsible gaming. We provide resources for guests who may have gambling concerns, including self-exclusion options and information about responsible gaming practices.

9.4 Right to Refuse Service

We reserve the right to refuse service to anyone who violates gaming rules, appears to be intoxicated, or otherwise behaves in a manner that management deems inappropriate or disruptive.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LUXURY HOTEL CASINO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY:

• ERRORS, MISTAKES, OR INACCURACIES OF CONTENT
• PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN
• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES
• ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICES BY ANY THIRD PARTY
• ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES

THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

11. Indemnification

You agree to defend, indemnify, and hold harmless Luxury Hotel Casino, its affiliates, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the services
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your actions caused damage to a third party

This defense and indemnification obligation will survive these Terms and your use of the services.

12. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the services will immediately cease. If you wish to terminate your account, you may simply discontinue using the services or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Modification of Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the services.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Dispute Resolution

15.1 Informal Resolution

For any dispute you have with Luxury Hotel Casino, you agree to first contact us and attempt to resolve the dispute informally.

15.2 Arbitration

If the dispute cannot be resolved informally, you and Luxury Hotel Casino agree to resolve any disputes through binding arbitration in Las Vegas, Nevada, in accordance with the rules of the American Arbitration Association.

15.3 Exceptions

The foregoing arbitration agreement does not apply to:

• Disputes involving the protection of Luxury Hotel Casino's intellectual property rights
• Claims for injunctive relief
• Any claim that may be brought in small claims court

15.4 Class Action Waiver

You agree that any arbitration or court proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, (a) no arbitration or court proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated or resolved on a class action basis; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
